Discipline Panel Decisions

Panels of the Discipline Committee ordered the summaries of recent disciplinary cases to be published in Professionally Speaking.

A panel of the Discipline Committee held a public hearing on October 30, 2001 and April 8 and 9, 2002 into allegations of professional misconduct against Louis Kakoutis of Richmond Hill. Kakoutis, 46, was certified to teach in 1980. He represented himself at the hearing on October 30, 2001 but left in the morning of the April 8, 2002 session and chose not to return for the remainder of the hearing.

The allegations of professional misconduct against Kakoutis included performing acts that would be regarded by members as disgraceful, dishonourable or unprofessional and engaging in conduct unbecoming a member.

The discipline panel heard testimony that Kakoutis repeatedly communicated with the board office and the board’s legal counsel in a manner that was at times abusive and profane and that his telephone calls upset and frightened staff. Kakoutis continued to communicate with the board despite being directed in writing by legal counsel to stop doing so.

The panel noted that Kakoutis showed an inability to control his behaviour during the hearing and that he insulted the chair of the panel, College legal counsel and the independent counsel to the panel. He also used inappropriate and profane language during the proceedings.

The panel found Kakoutis guilty of professional misconduct and ordered his Certificates of Registration and Quali- fication suspended for six months with conditions.

The conditions include that Kakoutis may not teach or engage in any other employment related to the teaching profession until he has undergone, at his own expense, a full psychiatric assessment. The assessment must address, but is not limited to, the areas of anger management and impulse control and any other behavioural or psychiatric issues that may affect Mr. Kakoutis’ ability as a teacher. The assessment must be done by a psychiatrist acceptable to the Registrar and any treatment required as a result of the assessment must be completed to the satisfaction of the Registrar.

The decision of the panel appears on the College’s public register.

A panel of the Discipline Committee held a public hearing on June 3 into allegations of professional misconduct against Bob Bill Mavrothalassitis of Burlington. Mavrothalassitis, 31, was certified to teach in 1998 and was a teacher at the Halton District School Board at the time of the incident. He attended the hearing and was represented by counsel.

The allegations of professional misconduct against Mavrothalassitis included providing false information to the College; failing to maintain the standards of the profession; signing or issuing a document that he knew or ought to have known contained a false, improper or misleading statement; committing an act that would be regarded by members as disgraceful, dishonourable or unprofessional and engaging in conduct unbecoming a member.

The panel heard that Mavrothalassitis enrolled in an Additional Qualification (AQ) course—Special Education, Part 1—by submitting his Interim Certificate of Qualification, which he had falsified. Mavrothalassitis had removed a condition from his certificate that stipulated that he had to complete an Additional Basic Qualification (ABQ) course before he could take any AQ course.

Mavrothalassitis pleaded no contest to the allegations at the hearing. The panel accepted his plea, as well as an agreed statement of facts and joint submission on penalty. The panel found Mavrothalassitis guilty of professional misconduct and ordered his Certificates of Registration and Qualification suspended for a two-month period. The panel also ordered that Mavrothalassitis be reprimanded. The decision of the panel appears on the College’s public register.
