Dispute Resolution Program
The College uses Dispute Resolution (DR) to facilitate the resolution
of some complaints regarding members of the profession. DR is voluntary
and without prejudice to the parties. Agreements arising from this process
protect the public interest and the results are similar in nature to those
expected from a full investigation or hearing.
The College's committees consider the public interest when determining
whether publication of such matters is necessary. The College monitors
compliance with all agreements reached through DR.

Decision: Certificates of Qualification and Registration cancelled
Following notification by the Keewatin-Patricia District School Board,
the Registrar initiated a complaint against Bruce Robert Hemsworth, alleging
that he indecently assaulted three female students.
The Investigation Committee ratified a memorandum of agreement between
Hemsworth and the College, in which Hemsworth agreed to:
- resign his membership
- the cancellation of his certificates by the Registrar
- not reapply for membership in the College for three years and not
seek or engage in employment where Certificates of Qualification and
Registration are required
- the publication of his name with a summary of the complaint and its
resolution in Professionally Speaking / Pour parler profession
- a notation on the public register regarding his resignation and the
cancellation of his certificates, including a statement that at the
time of the resignation a professional misconduct investigation was
in progress regarding allegations of indecent assault of three female
students
- College notification of the cancellation of his certificates to his
former employer and the education authorities routinely informed of
such disciplinary action.

Decision: 14-month suspension
Following notification by the Kawartha Pine Ridge District School Board,
the Registrar initiated a complaint alleging that David J. McMurray engaged
in inappropriate conduct with a female secondary school student. The Registrar
alleged that the inappropriate conduct included McMurray kissing the student,
making inappropriate and personal comments to her and sending her a series
of inappropriate and personal e-mail.
The Investigation Committee ratified a memorandum of agreement between
McMurray and the College in which McMurray agreed:
- that he committed professional misconduct by engaging in an inappropriate
relationship with a female student
- that his Certificates of Qualification and Registration would be
suspended for a period of 14 months
- to complete a course of instruction regarding maintaining appropriate
student-teacher behaviour
- to undergo an assessment regarding whether he is able to return to
teaching without the risk of harm or injury to students
- that following the assessment the assessor would provide the Registrar
with a report regarding McMurray's ability to return to his teaching
responsibilities
- to complete any course of treatment recommended by the assessor
- to a notation on the College's public register indicating that his
certificates were suspended for a period of 14 months and that at the
time of the suspension a professional misconduct investigation was in
progress regarding the member's inappropriate relationship with a female
secondary school student
- to publication of his name with a summary of the complaint and its
resolution in Professionally Speaking / Pour parler profession
- College notification of the suspension of his certificates to his
former employer and the education authorities routinely informed of
such disciplinary action.

Decision: Assessment of the member's ability to return to teaching
Following notification by a school board, the Registrar initiated a complaint
against a member of the College alleging that he criminally harassed an
adult female and threatened to cause her death. The member had pleaded
guilty to criminal charges of harassment and uttering a threat.
The Investigation Committee ratified a memorandum of agreement between
the member and the College, in which the member agreed:
- not to seek or engage in employment where Certificates of Qualification
and Registration are required until such time as the Registrar has been
provided with a written report from an appropriate practitioner indicating
that he is able to return to full-time teaching duties without creating
a risk of harm or injury to students or the school community
- to complete any treatment recommended by the assessor
- to have no communication with the adult female he had harassed and
threatened
- to immediately inform the Registrar in writing of any future criminal
charge or conviction
- to provide the Registrar with the teacher performance appraisals
required by the Education Act should he gain employment requiring
Certificates of Qualification and Registration
- to publication of a summary of the complaint and its resolution,
without identifying him, in Professionally Speaking / Pour parler profession.

Decision: Cautioned by the Investigation Committee
Following notification by a school board, the Registrar initiated a complaint
against a member of the College alleging that he had brought marijuana
to school.
The Investigation Committee ratified a memorandum of agreement between
the member and the College in which the member:
- acknowledged that he brought marijuana to school and that such behaviour
constituted professional misconduct
- agreed to be cautioned by the Investigation Committee regarding his
actions
- agreed to publication of a summary of the complaint and its resolution
in Professionally Speaking / Pour parler profession without
identifying him
- agreed that the College would notify his current employer of the
Investigation Committee's decision, including the details of the resolution
contained in the memorandum of agreement.

Decision: Cautioned by the Investigation Committee
Following notification by a school board, the Registrar initiated a complaint
against a member of the College alleging that he had dragged a male student
out of a school change room.
The Investigation Committee ratified a memorandum of agreement between
the member and the College, in which the member agreed:
- that he had engaged in professional misconduct by dragging a student
by the arm
- to be cautioned by the Investigation Committee with respect to the
Registrar's complaint
- to successfully complete two classroom management courses
- to provide the Registrar with written proof of completion of the
two classroom management courses
- to undergo a performance appraisal within 20 assigned teaching days
- to provide the Registrar with a copy of the written performance appraisal
within 30 calendar days of its completion
- to publication of a summary of the complaint and its resolution without
identifying him
- that the College would provide his current employer with a copy of
the Investigation Committee's decision regarding the memorandum of agreement.
