Dispute Resolution Program

Dispute Resolution (DR) is undertaken for suitable complaints regarding members of the profession. DR is voluntary and without prejudice to the parties. Agreements arising from this process protect the public interest and are similar in nature to decisions expected following a full investigation or hearing. The College’s committees consider the public interest when determining whether publication is necessary. The College monitors compliance with all agreements reached.

Member Name: Stanley Michael Haliniak
Registration Number: 112925
Decision: Certificate of Qualification and Registration Cancelled

Following notification by the Toronto District School Board, the Registrar initiated a complaint against Stanley Michael Haliniak, a secondary school teacher, alleging that he rubbed his arm against the breasts of 15 female students. The member pleaded guilty to and was convicted of one count of sexual exploitation involving an 18-year-old female student. Other related criminal charges were withdrawn.

The Investigation Committee ratified a memorandum of agreement between the member and the College, in which the member agreed to:

  • resign his membership
  • the cancellation of his certificate by the Registrar
  • not reapply for membership in the College for five years and not teach in any elementary, secondary, public, private or separate school
  • publication of the Member’s Name with a summary of the complaint and its resolution in Professionally Speaking
  • a notation on the public register regarding the member’s resignation and cancellation of his certificate including a statement that at the time of the resignation, a professional misconduct investigation was in progress regarding the member’s inappropriate sexual touching of female students
  • College notification of the cancellation of the member’s certificate to his former employer and the education authorities routinely informed of such disciplinary action.

Decision: Certificate of Qualification and Registration Cancelled

Following notification by the Limestone District School Board, the Registrar initiated a complaint against Michel Guy Launay, an elementary school teacher, alleging that he allowed female students to sit on his lap and to brush his hair. The Registrar also alleged that the member rubbed the backs of female students under their clothing, tickled them, and gave them piggy-back rides.

The Investigation Committee ratified a memorandum of agreement between the member and the College, in which Mr. Launay agreed to:

  • resign his membership in the College
  • the cancellation of his certificate by the Registrar
  • not reapply for membership in the College at any time in the future
  • not teach in any public, private or separate school
  • publication of his identity with a summary of the complaint and the nature of the resolution in Professionally Speaking
  • a notation on the public register that he resigned his membership in the College and that the Registrar cancelled his certificate. The notation also includes a statement that at the time of the resignation, a complaint against the member for professional misconduct was under investigation
  • College notification of the cancellation of the member’s certificate to his former employer and the education authorities routinely informed of such disciplinary action.

Decision: Member Cautioned by the Investigation Committee

The Registrar of the College alleged that during the period of 1999 to September 2000, Douglas W. Manning engaged in inappropriate conduct with a female student. The alleged conduct included discussing personal information about himself with the student, giving her personal gifts, offering to drive her to and from school, and writing her an inappropriate personal letter.

The Investigation Committee ratified a memorandum of agreement entered into by the member and the College which included the following terms:

  • the member agreed to be admonished by the Investigation Committee
  • the member agreed to attend, at his own cost, a course of instruction regarding the impact on adolescents of breaches in the teacher-student relationship
  • the member agreed to publication of his identity with a summary of the complaint and the resolution in Professionally Speaking.

Decision: Member Cautioned by the Investigation Committee

Following notification by a school board, the Registrar initiated a complaint against a male secondary school teacher alleging that he assaulted a male student by punching and grabbing him.

The Investigation Committee ratified an agreement entered into by the member and the College, in which the member agreed to the following terms:

  • completion of a course of instruction, at his own cost, regarding the appropriateness of physical contact with students and strategies regarding discipline of students
  • completion of a classroom management course
  • a written caution from the Investigation Committee
  • publication of a summary of the complaint and its resolution, without the member’s identity, in Professionally Speaking.
